A Patriot’s view of the history and direction of our Country
under the interstate commerce clause. This federal law applies
because telephone communications are interstate commerce.
The concept of the federal government being limited in its
powers by the people, and the states having powers not provided
for by the federal government is unique in the world. It is part of
the framework that makes our Country a republic of the several
sovereign states.
Regarding both the Ninth and Tenth Amendments, and the
powers of government and the people – the powers of the
government are by the people. So, how is it the government
continues to pass laws that infringe on the individual and collective
rights? How is it they are able to force states to pass laws that
infringe on State’s rights and the rights of the People?
My answer is that the Constitution provides that the
government can enact laws for the general welfare of the people.
My reading and research is that such laws cannot be prejudicial
against a person or group (i.e. race. gender, etc.) and must be for
good cause. For a right, such as that of a felon’s right to possess a
firearm or vote, to be revoked falls under this. If you read the
preamble to almost any enacted law, it most often starts with 'In
order to provide for the general welfare of the people, Congress [or
State of] hereby...'. How do these abuses of the people by their
government come to be? As long as there are citizens and
government, there will be acts of oppression and tyranny – perhaps
not as blatant as historically, but gradual is how change is best
made. Like learning any skill, slow and methodical processes that,
when connected, present a skill.
