Believe the Totality of the Evidence - AFI-LLC Newsletter July 2020
Instead of passing judgement of any kind before I know all there is to know, let me pose some questions about the
Brooks shooting. I would ask. Why were they interacting with this man? What happened prior to the shooting, to add
context to the fear (if any) being experienced by the officer. A conducted electrical weapon (TASER) is a less than lethal
option, for certain. It is designed to cause neuro-muscular incapacitation (NMI). This means it can "incapacitate"
someone. Officers are trained that a person using such a weapon against them is a significant threat and deadly force
may be justified. As for the weapon, I am curious to know what model of the CEW it was. People may not realize that
some of the weapon models manufactured today are capable of multiple deployments and not just one, like the older
models. Then there is the real-world observational capabilities of the officer. What was he focused on, what did he think
was happening, and so on. We must always remember we are watching the video from a god-like perspective, without
any of the experience of the officer. We can see things he or she may not. We have the advantage of knowing what is
going to happen, where the officer is in it at that moment. As for the fleeing individual not posing a threat, I do not know
what information that is being based on. If he fought with and possibly disarmed a police officer, he most certainly poses
a potential threat. The threat level depends on everything I wrote here, and more.
Let's not jump to conclusions, but rather wait for a thorough investigation to be completed before we pass judgement.
Let's base our perspectives on what the facts tells us and not the emotional responses being driven by the media and
specific hate groups.

This course will provide matter-of-fact answers to those questions, and clarification to common misconceptions about
police work. You will be taught which specific documents should be included in discovery for common types of criminal
cases. You will also learn why the identification of missing discovery documents might be more important than properly
evaluating the documents included in the case file. From scene evaluation to interviews to evidence collection to report
writing, you will gain a better understanding of how police are trained in these procedures. You will also begin to
understand why their efforts sometimes fall short, and how the defense team can leverage those shortcomings in every
criminal case you investigate.
