Protecting the Right to Organize Act – Congress Aims to End Subcontractor Employees

This is not a new bill – the same was introduced in 2019 and faded away (HR 2424 116th Congress). This re-introduced
bill is gaining support and traction (HR 842 117th Congress). The first draft of the bill has already passed the house and
now is in the Senate. It is a pro-labor union bill, if passed, would prohibit the hiring of 1099 subcontractors – Professional
Investigators could not hire another colleague to perform work which they do themselves; location does not matter. If
you are a surveillance investigator in Colorado and need surveillance in California – you have to hire a W2 employee;
regardless if hired individually or through companies. Many Professional Investigations – persons in every profession –
engage in this practice every day. This would end these arrangements and bring many investigations – civil, criminal,
worker compensation, probate, etc. to a halt. It would greatly impact prosecution, plaintiff, defense, victim, and
claimant abilities to assert or defend their position. California passed the law this is based on and introduced by
California members. At the time, the California Association of Licensed Investigators (CALI) met with bill sponsors and
presented various concerns and were able to get an exemption. There are no exemptions to this federal bill, which has
been sneaking around the Congress with little attention, it is now getting traction.
