Ernst Bester Trust v CIR

 Dealt with mining of sand on a farm

 Found that s 22 was not applicable to sand

still in the ground (not yet mined).

 Sand not removed could therefore

not be seen as part of trading stock

and as such cannot be classified as

opening stock.
