The law of employment




               Disciplinary procedures

               It is common practice for a company to have written disciplinary rules and procedures
               to deal with employee performance and conduct.  Staff should be notified about
               these rules and procedures.


               The rules should state what is acceptable and unacceptable behaviour in the
               workplace and what action will be taken if the rules are broken.

               The rules should also clearly say when someone might face disciplinary action and
               what that action could be. Employees should also be provided with the name of
               someone they should appeal to if they are unhappy about a disciplinary decision.

               The disciplinary rules should give examples of what will be treated as gross
               misconduct. This is misconduct judged so serious that it is likely to lead to dismissal
               without notice, e.g. fraud and theft.
