Judgment Enforcement – The Step-by-Step Course



                    Method  4 (Advanced):  Finding Judgments through the Bankruptcy Court.


                    More on this on the forum. What I want you to know here, is that bankruptcy courts render
                    judgments too, and these judgments cannot be bankrupted against.  I
                    know a JE who practically only does bankruptcy judgments. And she’s
                    terrific at it.


                    She goes through the bankruptcy website on PACER (for federal
                    judgments)


                       ✓  Looks for “AP” cases – adversary proceedings. This is where someone sued the
                           debtor in bankruptcy court for fraud, theft, blah blah, and the judgment is still good.
                       ✓  She runs her databases, and sees if the debtor who was sued in bankruptcy, is now a
                           better debtor.
                       ✓  She takes assignment and enforces the judgment.


                    This is a bit more complicated, so I’ll reserve more about this for the forum.

                    My point is that bankruptcy judgments are good too. One of my fastest case was a

                    bankruptcy judgment for 130K, and JD was building a home right up the street from the
                    JC. She called me. I took assignment. Renewed the judgment (it was about to expire). And
                    put a lien on his home. His attorney called, and we worked something out right away.




                    Method 5:  Using your Professionalism


                       This is a no-brainer. Your professionalism will get you more cases than you now
                    realize, and probably some of the best cases you’ll ever get. Everyone who has been in this
                    business awhile has experienced opposing a JD or his attorney in court,
                    and then getting a call later that same week from the JD or his attorney
                    saying they have some judgments to assign you. That means our skill,
                    appearance, and dedication is being observed. To the extent that we are
                    professional and effective, we gain more judgments, and even better

                    judgments.  Ask around of those old-timers in the business. They’ll
                    agree.
