                                          Liens, Levies and Garnishments



















                    Step 1: Lien everything that you can:

                        I took a judgment recently here in NY, and my first thought was to lien everything that
                    I could. Two main ways to lien the JD’s property:

                                                  1.  Real property lien, and

                                                  2.  UCC Lien


                    Step 2: How to Put a lien on the JD’s real property

                        Note:  Any of the competent professional databases will locate
                    just about ANY real property the JD has in almost any state.

                        When a JD has real property, the judgment is often as good as gold. Especially if the
                    economy is good, and home prices rising.
                        Your goal is to put a lien on the property to secure the judgment, and then later decide
                    whether:

                            ✓  to wait for the JD to refinance with a different lender, or sell the property,
                                while in the meantime the judgment is collecting interest

                            ✓  or to threaten a “forced sale” of the property to encourage the JD to refinance
                            ✓  or to have the sheriff do a forced sale of the property
