Judgment Enforcement – The Step-by-Step Course

What kind of questions can I ask?

You can subpoena and ask any question that “tends in logic to possibly lead toward the
discovery of assets.” For example, you can ask where the bank accounts are, what autos

and equipment the corporation owns and where they are, and so on. You can also ask the
name, address, and phone number of the person who does the taxes. They will get the
message: that next you’re going to bring in their tax person. They won’t like that at all at
                    all.

                    What’s the JDX Cost?

Fees will vary by state. Probably between $40 and $80 to the court. Your mileage may
vary a little. And then whatever the cost is for serving the JD. And, if you bring in the
account, spouse, or someone else not on the judgment, then there will be “witness fees.”

Application for order of examination of judgment debtor - Per CA Code CCP116.820 Total Fee: $60

Do I need a court reporter?

You’ll have to decide. I’ve used a court reporter when I thought the
dollar amount of the judgment warranted it, and where I thought it
might intimidate the JD. Court reporter might be an extra $100-$300.

Sometimes the JDX itself is scary enough. Causes FUD – Fear, Uncertainty, and doubt.
I’ve had JD’s on smaller judgments wait outside the courthouse with payment in hand.
