Judgment Enforcement – The Step-by-Step Course
First, the Agreement - It’s a Contract
There are two (2) documents to send the JC.
1. The agreement to purchase the judgment (below)
2. The Acknowledgement of Assignment of Judgment
If you turn to Appendix #5, you’ll see a sample copy of an actual
Agreement to Purchase that I’ve used. There is also a template in MS Word
format on the Forum, File #4 under Peter’s Course Files, that you can use.
Different JE’s in the business have different formats, but this is one that
I’ve tweaked with attorneys, and I have had no problems with so far.
The Agreement states the following:
✓ Who the Original Judgment Creditor is (the JC or OJC)
✓ Who I am – the New Creditor (the JE)
✓ The court case number and judgment amount
✓ Name and last known address of debtor
✓ The terms of the agreement: That I am purchasing the judgment for 50%
of its value (or whatever I agree on).
✓ That payments on the judgment will be deferred until collection begins.
✓ That all costs are on me.
