               9         Do Advance Directive documents have to be signed?


                         Yes. You must sign it, or have someone sign the document in your presence, and at
                         your direction, if you are unable to sign. Also, be sure to date it.

          10             Do the Advance Directive documents have to be witnessed or notarized?


                         Idaho does not have a legal requirement to have the documents witnessed or
                         notarized. But all other states require their advance directives to be witnessed or
                         notarized or both. If you want to ensure that your documents will be honored in
                         other states, having your signature witnessed or notarized is a good idea.

                         If you decide to have the documents witnessed, it is recommended that the
                         following people SHOULD NOT service as witnesses:

                         •  Your healthcare agent.

                         •  Your doctor or other treating healthcare provider.

                         •  An employee of your treating healthcare provider, unless they are related to you.

                         •  An operator of a community care facility.

                         •  An employee of an operator of a community care facility, unless they are related
                           to you.
