Protection with respect to such loan and for any state or federal aid available for the project or the financing
thereof; and that the Select Board is authorized to enter into a project regulatory agreement with the Department
of Environmental Protection, and to execute all other documents and take any other action necessary to carry out
this project.

ARTICLE 8: Voted unanimously to transfer the sum of $350,000.00 from Water Department Retained Earnings
for the Water Department for all related, relevant and necessary expenses associated with any and all Pumping
Station(s) Evaluations and Pilot Study’s for emerging containment treatment.

ARTICLE 9: Voted unanimously to appropriate the sum of $33,000,000.00 for the purpose of financing the
construction and equipping of the Middleborough East Grove Street Water Treatment Plant, including
landscaping, earthwork, exterior work, replacement of the garage, and repairs to the existing pump house, and
including without limitation all costs thereof as defined in Section 1 of Chapter 29C of the General Laws and all
related, relevant, and necessary expenses associated therewith; that to meet this appropriation the Treasurer with
the approval of the Select Board is authorized to borrow $33,000,000.00 and issue bonds or notes therefor under
Chapter 44 and/or Chapter 29C of the General Laws or any other enabling authority; that all or a portion of such
amount may be borrowed from the Massachusetts Clean Water Trust (the “Trust”); that such bonds or notes shall
be general obligations of the Town with the intent that debt service be paid in the first instance from the Water
Enterprise Fund; and in connection therewith to authorize the Select Board to enter into a financing agreement
and/or security agreement with the Trust and otherwise to contract with the Trust and the Department of
Environmental Protection (“DEP”) with respect to such loan and for any federal or state aid available for the
project or for the financing thereof; and that the Select Board is authorized to enter into a project regulatory
agreement with the DEP, to execute all documents and to expend all funds available for the project and to take
any other action necessary to carry out the project.

Earnings for all related, relevant and necessary expenses associated with the Wastewater Department Asset
Management Program.

truck; that to meet this appropriation the Treasurer with the approval of the Select Board is authorized to borrow

therefor;
