LCJ’s efforts are focused on the Federal Advisory Committee on Civil Rules, which is
now examining whether to adopt a new federal disclosure rule.
LCJ is also building a database
of discovery requests, motions,
and court orders that will be
used to highlight the inconsistent
approaches courts are currently
taking on TPLF disclosure. This
database will support LCJ’s
advocacy with the Advisory
Committee on behalf of TPLF
disclosure rules. You could make
a real difference in this effort by
sharing your specific case examples.
Why is your experience TPLF
so important? The Advisory
Committee on Civil Rules wants
to understand whether the
TPLF poses merely “theoretical
problems” or concrete issues that
deserve FRCP guidance. LCJ is
building the case that undisclosed
TPLF contracts hinder litigation,
frustrate resolution discussions,
and inhibit good judicial case
management. Sharing your
experiences will help demonstrate
that a uniform TPLF disclosure rule
is needed.
Regardless of whether your efforts
to obtain TPLF disclosure were
successful or not, your experience
will helping demonstrate that
a uniform rule requiring TPLF
disclosure is the fair and efficient
way to provide courts and parties
necessary information while
avoiding unnecessary motion
practice.
