Article 30(1) though styled as a right, is more in the nature of protection for minorities. But for Article 30, an educational institution, even though based on religion or language, could have been controlled or regulated by law enacted under clause (6) of Article 19. (P.A. Inamdar and Others v State of Maharashtra and Others, 2005(5) Kar. L.J. 161 (SC) : AIR 2005 SC 3226 : (2005)6 SCC 537).
Article 30(1) gives religious and linguistic minorities the right to establish and administer educational institutions of their choice. The use of the words “of their choice” indicates that even professional educational institutions would be converted by Article 30. Section 29 of the Right of Children to Free and Compulsory Education Act, 2009 which requires minority/non-minority institutions to follow National/State curriculum does not abrogate Article 19(1)(g) or Article 30. (Society for Un-Aided Private Schools of Rajasthan v Union of India and Another, 2012(3) Kar. L.J. 177 (SC) : AIR 2012 SC 3445 : (2012)6 SCC 1 : 2012(4) SCJ 318).
Minority - Linguistic and religious minorities are covered by the expression “minority” under Article 30 of the Constitution. Religious and linguistic minorities, who have been put at par in Article 30, have to be considered State-wise. (T.M.A. Pai Foundation and Others v State of Karnataka and Others, 2003(1) Kar. Minority whether linguistic or religious, is determinable only by reference to the demography of a State and not by taking into consideration the population of the country as a whole. (P.A. Inamdar v State of Maharashtra and Others, 2005(5) Kar. L.J. 161 (SC) : AIR 2005 SC 3226 : (2005)6 SCC 537).
