"qualified," then the earnings on the deferrals will not be subject to income tax when distributed from the Plan.

Employer Safe Harbor Contribution Election
To help employees make an informed decision on the level of elective deferral contributions, if any, Erbe must inform employees about the contributions it will make to the Plan. Erbe has elected to make the following employer safe harbor contribution:
Safe Harbor Matching Contribution. In order to maintain "safe harbor" status, Erbe will make a safe harbor matching contribution equal to 100% of the employee’s elective deferrals that do not exceed 3% of compensation plus 50% of elective deferrals between 3% and 5% of compensation.
For purposes of calculating this safe harbor matching contribution, the employee’s compensation and deferrals will be computed for the Plan Year.
Vesting
Employees are always 100% vested in all elective deferrals they make to the Plan. Matching contributions made after January 1, 2020 are 100% vested for the employee. This effective date reflects Erbe’s change to Safe Harbor Matching Contributions.
Plan Fiduciary
As plan fiduciaries, Erbe executive management is prohibited from providing investment or tax advice to plan participants. As administrator of the plan, the Director of Human Resources has the same restrictions. For this reason, employees are strongly encouraged to seek their own outside investment and tax advice.
9-11. Employee Wellness & Well-Being
Erbe offers a variety of programs to assist in the wellness and well-being of employees and their families. All employees, regardless of full- or part-time status, are eligible for these benefits.
Employee Assistance Program
Erbe understands that balancing work and personal life can sometimes be challenging. Employees are provided access to an Employee Assistance Program that affords employees a confidential setting in which to receive counseling on a variety of topics and issues. Topics may include stress management, finding childcare, retirement planning, financial/legal concerns, relationships, or being faced with grief, loss or the impact of a disability. Counselors are available 24 hours a day, seven days a week.
Use of this EAP is voluntary and strictly confidential.
