Chapter 2: The Key Players
federal immigration authorities enforce federal
immigration laws. So, the attorney general of California
has threatened to punish California residents under the
Immigrant Worker Protection Act for cooperating with
federal agents. The result is a threat to the integrity of
the United States that could lead to civil unrest.
One of the most important supreme court
decisions in America’s history is a famous court
decision of McCulloch versus Maryland in 1819 where
the court held that the federal government is supreme to
the states. The case confirmed that it is unconstitutional
for a state to sabotage legal actions of the federal
government. If states can choose to ignore any federal
law, not just immigration laws, but any federal law, we
no longer have a sovereign country.
Besides issues of states versus the federal
government, we also have the possibility of rogue
federal agencies acting independently of the executive
branch of government. For example, when the Federal
Bureau of Investigation (FBI) and the Depart of Justice
(DOJ) abused their power of surveillance to influence
a presidential election and continued to undermine a
sitting president, presidential authority is compromised.
Federal departments put the republic in jeopardy when
they try to dictate events and act at cross purposes to a
sitting president.
At times unelected bureaucrats make decisions.
For example, The Food and Drug Administration
passed the “Deeming Rule” which ordered that vaping
products be subject to the same regulations as enforced
on the cigarette industry under the Tobacco Control Act
