INTRODUCTION Antimicrobial claims language can seem like a minefield; that’s why the experts at Microban have created this informative booklet to help you effectively promote your antimicrobial- treated product in-line with legislation from governing regulatory bodies. Biocidal Products Regulation: What Is It? The Biocidal Products Regulation (BPR, Regulation (EU) 528/2012) concerns the marketing and use of biocidal products, which are used to protect humans, animals, materials or articles against harmful microorganisms by the action of the active substances contained in the biocidal product. The BPR impacts all companies involved in the supply and/or use of biocides. Microban® International is a supplier of biocides, more commonly referred to as antimicrobial additives. As our customer, we supply you with an appropriate additive that is used in the manufacture of your Microban®-protected product, otherwise known as a ‘Treated Article’. Treated Article vs. Biocidal Product A ‘Treated Article’ is any product containing an antimicrobial agent, without its primary purpose being a biocidal product. For example: A phone case treated with Microban® is classed as a Treated Article. This is because although the case can resist colonisation by microbes, its primary function is to protect the phone from accidental damages. The antimicrobial feature is simply an added benefit. A ‘Biocidal Product’ is any product containing an antimicrobial agent, with its primary purpose being to destroy harmful microorganisms. For example: An antibacterial spray is classed as a Biocidal Product. This is because its primary function is to destroy harmful bacteria present on a surface. If you removed the active ingredient from the antibacterial spray, then it would no longer have any use. YOUR REGULATORY OBLIGATIONS FOR THE SUPPLY OF A TREATED ARTICLE CENTRE ON: 1. The use of a biocide that been approved by the appropriate regulatory bodies 2. The accurate labelling of your Microban®-treated product 3. The compliant marketing of your Microban®-treated product 4. A commitment to understanding the implications of selling a treated article. 5. Transparency about the active ingredient contained within your Microban®-treated product.
