This area which is still held by IPAC excludes the ‘Islands of Kharg
and Khargo and the three-mile territorial waters of each, which this
described area surrounds.’
On the Arabian side of the Gulf, the relevant concession agreements
arc:
(i) Agreement between the Government of Kuwait and Kuwait Shell
Company, 15 January 19611
According to Article 1 of this agreement, the concession area includes:
(I) All the seabed and subsoil underlying the waters of the Arabian Gulf
the subject of the Proclamation made by the then Ruler of Kuwait on
12th June, 1949, but excluding Concessionary Waters (as hereinafter
defined).
(II) Any and all islands, islets, shoals ... which fall within the jurisdic
tion of the Emir and lie within the boundaries of the area defined in (I)
above but excluding certain islands defined under this section and their
concessionary waters.
(ii) Saudi Arabia-Kuwait Agreements of 1957 and 1958 with Arabian
{Japanese) Oil Company (AOC) respecting the neutral zone offshore
areas2
By Article 2 of the AOC 1957 Agreement with Saudi Arabia, the
concession area includes ‘the Government’s undivided share in all
that offshore area outside the territorial waters limit of the Saudi
Arab-Kuwait Neutral Zone over which the Government now has or
may hereafter, during the period of this Agreement, have right, title
and interest’.
And by Article 1 of the AOC 1958 Agreement with Kuwait, the
concession area includes Kuwait’s undivided half interest in ‘the sea
bed and subsoil lying beneath the high seas of the Arabian Gulf
contiguous to the territorial waters of the Neutral Zone . . . with the
exception of the seabed and subsoil beneath the Concessionary
Waters’.
(iii) Agreement between the Government of Saudi Arabia and Arabian
American Oil Company (ARAMCO), 10 October 19483
This Letter Agreement grants Aramco concession rights over the off
shore areas of the Saudi Arabian northeastern coast on the Arabian
Gulf which extends from the Neutral Zone southward.
