2. I am advised that it is very doubtful whether a breach of quarantine regulations
is a crime or offence with in the meaning of Article 13 of the Maskat Order in Council of
tho 4lb Novcmhor lt$67. Having regard to other articles of tho 6umo Order, and especially
to Articks l‘J and 22, a distinction appears to he maintained between acts universally re
cognised as crimes and acts which for special purposes and by somo special rule are made
offences.
3. I desire, therefore, that His Majesty's Consul should bo instructed to promulgate
as soon as possible, under I he powers gi anted to him by Artiolo 1 of tho Order in Couocil, a
regulation which should make the offence of breaking quarantine at Maskat by British subjects
and British protected persons justifiable in tho Consular Court.
4. The opportunity might bo fcakon to consider whether there are any other pointe con-
neoted with tne municipal law at Maskat in respect of which it would be conduoivo to tho
maintenance of the Sultan’s authority as on indepoudent rulor that regulations should be issued
under the Ordor in Couucil.
651. The following notification was accordingly issued by tho British
Consul on 6th July l‘J03 :—
In pursuance and by virtue of tho powers vested in His Brilannio Majesty's Consul
by Article 1 of the Maskat Order in Council of 1867—
British subjects and British protected persons are hereby reminded that the Regulations
at present enforced by the Government of His Highness against arrival at
Maskat by sea, for tho prevention of plague and other epidemic diseases in his
territories, are a9 follows
Maskat Quarantine Regulations.
(1) All vessels arriving from ports affected with plague or ottmr infectious disease
arc placed in quarantine until ten day6 have elupsed since the date of their
leaving tho last infected ports.
(2) First class passengers are inspected prior to disembarkation, but are not plaoed in
quarantine on shore, unless there appear to the Health Officer to be speoial
grounds for that course.
(3) Stcoud class passengers are likewise medically inspeoted prior to disembarkation,
but are required in addition to present tbemselvc6 daily at the hospital for
medical inspection for the period of one week.
(4) Third class or deck passengers are inspected on board, and from thence conveyed
direct to the quarantine station by boat aud are required to remain there for
a period of one week.
(6) Ships of war on arriving from infected ports are required to quarantine their
crews on board until a period of ten days has elapsed since the date of depar
ture from tho last infeciod ports.
(6) No person is allowed to board any vessel which is in quarantine without special
permission from tho Health Officer.
(7) Persona violating these regulations are liable to puuishment with fine or impri
son mr-ut, or both.
The rules of His Highness abovo quoted will be strictly enforced against British subjects
and British-protected persons; and individuals charged with the breach thereof will be subject
on conviction to fine up to §500 or imprisonment for three months, in acoordanoe with
the provisions of Article 8 of tho said Order in Counoih
