TERMS, CONDITIONS & WARRANTIES
• Prices and/or design are subject to change without notice.
• Subject to all federal, state, and local taxes.
• Our products are LISTED OR CERTIFIED TO VARIOUS ANSI/UL SAFETY STANDARDS.
• Prices do not include bulbs, except where indicated with .
• All fans with a light source have lamps included.
TERMS: Net 30 days. Past due account subject to a service charge equal to 1.5% per month but in no event higher than permitted by law in the state where the obligation is payable.
CLAIMS for freight shipments received damaged or short shipped, must be made within 30 days of receipt.
FREIGHT: F.O.B. Kichler shipping point. Freight pre-paid on orders over $1,500.00 for all states (excluding Alaska). Alaska freight pre-paid on orders of over $2,500.00.
RISK OF LOSS : 1. Goods are sold F.O.B. Kichler shipping point. Risk of Loss passes to the purchaser when the goods are delivered to the carrier. In the event of loss or breakage, purchaser must le a claim with the delivering carrier (which does not relieve the purchaser of its obligation to pay for the goods in full with the above stated payment terms.) 2. Seller shall not be liable for any processing, handling or other costs, or any damages whatsoever, related to lost or broken goods.
RETURNS OF MERCHANDISE: May only be returned with an RMA#. No return will be accepted without this number. All returns for non-defective product must be returned freight prepaid and are subject to a 25% restocking charge.
LTL CHARGES: For orders that do not meet prepaid freight requirements, a charge of 7.5% of the order value or $60.00 will be applied, whichever is greater. ASSEMBLY: Some products require assembly. Use the instructions included with the product only.
DROP SHIPMENTS: A $15.00 handling charge will be applied on all drop shipments within the Continental United States. Request for drop shipments to other areas are subject to approval by Kichler. No trans-shipping of goods is permitted.
CREDIT CARD FEES: A 2% fee is applied to all credit card transactions.
INTELLECTUAL PROPERTY - Infringement of Kichler Lightingís copyrights, trademarks, and patents will be aggressively pursued up to and including court action.
