agents, consultants or employees, it being understood and agreed that in such matters they act
exclusively as agents and representatives of the Village.

                             III. INFRASTRUCTURE IMPROVEMENTS

         A. SANITARY SEWER - DEVELOPER CONSTRUCTED.

         1. The Developer shall be responsible to pay the full cost for the design and
construction of the onsite gravity flow sanitary sewer system as defined by the Village
Ordinances as required for connection of the Development to the sanitary sewer collection
system of the Village of Sturtevant Utility District, all of which plans must be reviewed and
approved by the Village and may be subject to further review and approval by the Racine Water
Utility and the State of Wisconsin Department of Natural Resources. The Developer shall
submit both electronic and paper form copies to the Village of the required plans and
specifications. Developer shall forward true and correct photocopies of all bids received
pursuant to the construction bid specifications and photocopies of any contracts to Village
Engineer for review. Village shall cooperate with Developer in obtaining all necessary permits
required from the State of Wisconsin and the Racine Water Utility for such sanitary sewer
approval.

         2. The Developer shall provide all construction staking and the Village shall make
all appropriate inspections of the onsite sanitary sewer improvements. The Developer shall
prepare all record drawings and systems updates. The Developer shall provide both paper and
electronic copies of all plans and specifications. All related costs for these items shall be paid by
the Developer.

         3. Village shall accept onsite public sanitary sewerage systems improvements
constructed by Developer, if any, located in the public right-of-way or in any easement lying
within Property upon (i) completion in accordance with approved plans and specifications, (ii)
construction and delivery without defect, damage or non-conformance, (iii) delivery to Utility of
certified copies of all tests of sanitary sewerage system, (iv) receipt of lien waivers from all
contractors, (v) review and certification by Village Engineer of the above and (vi) receipt of
recorded easement documents. Said acceptance shall be subject to approval by the Village.
Upon acceptance by Village, Village shall be responsible for the operation and maintenance of
the publicly owned portion of said sanitary sewerage system, if any.

         4. Any buildings constructed in the Development shall be required to have
individual sanitary sampling manholes which shall be approved by the Village.

         5. Upon completion of the onsite sanitary sewer construction by Developer, and
verification by the Village Engineer that said sanitary sewer system has been constructed in
accordance with plans and specifications submitted, the Developer shall vest all right, title and
interest in the public portion of the onsite sanitary system, if any, and any easements required for
