Q. How do you prepare for performance review?
A. We are all busy and fitting in time to write performance reviews can be
challenging. However, the performance review is very important to each employee,
so I start early, drafting sections in Word, review notes from one-on-ones and keep
track of any awards/MIL Bucks and client feedback throughout the year. I also write
my draft before I review the self-evaluation, so I don’t just repeat what is in there. Our
employees do a great job throughout the year, so we owe it to them to put in the effort
on reviews!

Q. Do I need to conduct a review if my employee is on FMLA or any other protected leave of absence?
A. Keep in mind that the FMLA regulations state that employers cannot use the taking of FMLA leave as
a negative factor in employment actions, such as hiring, promotions, or disciplinary actions. Moreover, the
regulations require that the employee who has taken FMLA leave have the same or equivalent opportunity
for bonuses, promotions or merit increases.
Employees who are out on leave should have their performance evaluated as though they were not on FMLA
leave; however, the evaluation period should not include the time the employee is absent because it could
reflect negatively on the employee’s performance.
