(a) Any breach of contract
(b) Any use made by the client of the service; and
(c) Any representation, statement or tortious act or omission (including negligence) arising under or in connection with the contract.
14.3 Noting in this contract will limit or exclude the liability of Ranger Home Care for: (a) Death or personal injury resulting from negligence; or
(b) Any damage or liability incurred by the Client as a result of fraud or fraudulent misrepresentation by Ranger Home Care.
15. Data Protection
15.1 The client acknowledges and agrees that details of the Client’s name, address and payment record may be submitted to a credit reference agency, and personal data will be processed by and on behalf of Ranger Home Care in connection with the service.
16. Care Staff Breaks
16.1 Carers are entitled to a minimum break of two hours every day. This should be at a mutually convenient time for both the client and carer. Ranger Home Care are aware that in exceptional circumstances it will not be possible for the carer to leave the client alone. In these circumstances, the carer should have the additional time given to them during the week whereby Ranger Home care may offer to arrange alternative cover through a partner domiciliary agency. This arrangement shall be treated as a subcontract to this contract, between the client and Ranger Home Care. Ranger Home Care will be responsible for the management of this cover and will include the cost within their regular invoice. This cost will be determined by the contracted domiciliary agency and only decided upon after a quotation is received and discussed with the Client. The cover may be cancelled at no charge with 24 hours’ notice should the Client make alternative arrangements.
16.2 The company operates a policy of fortnightly rest breaks in accordance with regulations. Ranger Home Care will arrange appropriate cover during this period.
16.3 Carers can be permitted to wake and attend to their client to a maximum of twice per night, over and above the normal service hours of the Carer. There is an additional charge of £20 per hour or part thereof. It is a retrospective cost.
17. Gifts and Legacies
17.1 Clients are requested to adhere to the Policy and Procedure regarding gifts and legacies which is contained within the Client Handbook in order to protect the client and the carer.
17.2 Carers and their families shall not be involved in the drafting or execution of or be a beneficiary under the client’s wills or any other form of bequest or legacy.
