TEXAS PENAL CODE 46.13(c)

• Affirmative defense to prosecution, if the child’s access to the

firearm:

▫ Was supervised by an another adult for the purpose of

hunting, sporting, or other lawful purpose

▫ Lawful defense by the child of people or property

▫ Was gained by entering property in violation

▫ Occurred while handgun owner was engaged in an

agricultural enterprise
