As an employer in any industry,
it is important to remember that
the EA 2010 imposes the duty to
make reasonable adjustments
for any disabled employees. The
employer should keep abreast of
their employees’ state of health. One
relatively simple way of achieving
this is ensuring they complete annual
medical questionnaires to highlight
any issues.
If an issue arises and the employee
has not sought medical advice, the
employer should ask the individual
to visit their GP and provide a GP’s
report confirming any concerns. In
turn, the employer can look to make
any reasonable adjustments through
open discussions with the employee
and guidance from their GP or the
company’s Occupational Health
advisor.

Where an employee complains of
stress-related illnesses, perhaps
ask the employee to clarify exactly
what is making the feel stressed,
thus helping to tackle the problem
effectively at work. Taking this active,
rather than passive, approach could
assist if any employees do pursue
an employment claim in the future –
as evidenced in the case examined
