I would welcome the opportunity to attend your office on any day around midday commencing as you kindly say, Monday June 6th - how about Tuesday 7th or Wednesday 8th around midday if convenient for you?
I regret we have been run ragged by this particular lessee, Mrs M. Hillgarth, for years, as indeed were our previous Agents and indeed those previous to that, which I can further evidence when we meet.
I can also prove categorically whilst attending your office, that despite what you have been told in very unsubstantiated innuendo, that absolutely no lessee, including Mrs Hillgarth, made a formal nor indeed informal request to view any documentation from our YE2014 Service Charge Accounts (dated 30 May 2015) until Mrs Hillgarth’s email request on 17 December 2015
Mrs Hillgarth’s request was the only one received, and in fact the only one in the 5 years we have been managing our little block of 9 flats at Mitre House, SW3. Any reference to others is 100% unsubstantiated
In all our leases, including that of my own and those of my fellow Directors, and Mrs Hillgarth, it states quite clearly that requests to view documentation must be made (and made available) within 6 months of the year end accounts or summary.
  Schedule 8_pp17 (5)_The Lessor shall procure that there shall be open to inspection by the Lessee
during normal working hours during the daytime on reasonable notice in writing at the Lessor’s premises
for a period of six months following the date of the Accountant’s certificate the audited accounts for the preceding Maintenance Year and the Lessor shall further supply to the Lessee a summary of such accounts
Mrs Hillgarth’s email request on 17 December 2015 to view documents from our YE2014 accounts dated 30 May 2015 would appear therefore to be 6 months and 17 days and consequently not within the statutory period as outlined in her lease. We have also taken legal advice on this and it has been confirmed as such.
