An example: constructive dismissal
⚫ Employee claims she was constructively dismissed because her employer
unilaterally increased her hours of work
⚫ The ultimate issue: was she constructively dismissed?
⚫ And what does that turn on?
⚫ First, has the employee shown that her employer unilaterally increased her
hours of work; and if so, second, did the increase substantially change an
essential term of her employment?
⚫ The deep issues
