                                 “account information”: section 187(5);

                                (3) In the application of this Part, these expressions are to
                           be construed in accordance with the provisions of Part 3 —

                                 “a business in the regulated sector”: section 142(17);

                                 “financial institution”: section 149(6).


                                (4) A business is not in the regulated sector to the extent
                           that it engages in any activity prescribed by order made by the
                           Department of Home Affairs.

                                (5) But a person who for any reason ceases to carry on a
                           business in the regulated sector is to continue to be treated as a
                           financial institution for the purposes of any requirement under —

                                  (a) a customer information order; or


                                  (b) an account monitoring order,

                           to provide information which relates to a time when the person
                           was a financial institution.


                                (6) “Recovery order” and “interim receiving order” have
                           the same meanings as in Part 1.

                                (7) “Unlawful conduct” has the meaning given by section 2.

                                (8) References to notice in writing include references to
                           notice given by electronic means.

                                (9) This section and sections 196 to 198 apply for the
                           purposes of this Part.
