The threat of non-bid units, To/From subject reports and the performance recognition system
 I have fielded numerous calls regarding Offi- cers being “dumped,” or involuntarily reassigned, from their current units of assignment, specifi- cally Unit 124 (Education and Training Division) and Unit 193 (Gang Intelligence Division). Both of these units, 124 and 193, are non-bid units, or not subject to the bidding process. Therefore, when changes occur in leadership, changes occur in the rank and file within these units. Officers either receive a call at home telling them that they are to report to a new district with literally just a few
hours of notice, or some are actually told in person by a ser- geant who still may give a shit about the people they directly su- pervise. I wish this practice would end altogether and at least al- low a full police period for advance notice of reassignment. The process in place is broken and leaves Officers wondering what they did wrong, how they may have improved — or did they just not have enough clout to withstand the change in bosses?
Be advised that there is no grievance process for being “dumped.” But if you are asked to perform a task that you deem to be unsafe or beyond your level of training, document dates, times and supervisors who gave you the order. If you refuse this unsafe order, these same supervisors may then ask you to com- pose a To/From subject report, directing you to choose a district so that you can be “dumped.” And that’s perfectly fine, but en-
sure that you document the unsafe order(s) that you were given on this same To/From before you are involuntarily reassigned. Cite your work history, disciplinary history as well as perfor- mance evaluations. Remember officers, these To/From reports become permanent records so document everything.
Lastly, certain bosses have taken it upon themselves to jack- pot Officers who are being dumped with negative Performance Recognition Evaluations, oftentimes just to shore up a reason to “dump” the Officers from their non-bid units. Officers, accord- ing to Employee Resource E05-01, there is an appeal process in place if the evaluation is rejected by the member. This process will be done by requesting a review of their performance eval- uation by their district or unit commander. The member must document the reasons for the rejection of the PES within seven calendar days of the date the member reviewed and refused to accept the overall performance evaluation rating. The district/ unit commander’s decision will remain final for any rating other than “unacceptable.” If the member’s performance evaluation remains “unacceptable,” then the member may request a sec- ondary hearing with the deputy chief. Please follow the order so you are awarded a fair process.
Remember to document all pertinent information, especially witnesses, because the department will.
