Appealing a Medicare Rule or Regulation
An example would be extending the 100 day limit for care at an inpatient skilled
nursing/rehab facility. The appeal can be managed by the patient or his or her
respresentative, but an attorney is recommended. There is no filing fee. The
first appeal goes to Livanta, LLC, and they will review the medical records and a
statement from the patient or his or her representative. The statement must be
very detailed when explaining the reason(s) for the appeal. The process takes
about two to three days. When you call, leave a message and they will return the

The decision is issued in a BFCC-QIO Determination Letter. If your appeal is
turned down, Livanta, LLC will refer you to the next appeal level at Maximus
Federal Services, Inc.
