 Process for Probation a Will
1. Original Will and a Copy of the Death Certificate.
2. If original witnesses are deceased or unavailable, someone must accompany family
and verify signature on will.
3. Executor/executrix must be present to probate.
4. If will is executed with husband/wife survival, will is not necessarily subject to probate.
5. If there are one or more objects - that is a car, home, etc. - in the descendant’s name,
will must be probated.
6. An appointment is necessary to probate the will.
7. Ten (10) days must pass after the death before the will can be probated - that is on
the eleventh (11th) day.
8. THE SURROGATE”S OFFICE IS OPEN FROM 8:45 AM TO 4:15 PM Monday through
Friday.
9. Minimum fee of $100 for two (2) pages (each additional page $5) that will entitle you
to one free copy of Surrogate paper. Each additional copy of Surrogate paper is $5.
10. An additional fee may be charged if original witnesses have moved from state and
must be notified for verification of signatures.
11. If owned jointly you do not have to probate; only if assets is solely in the descendent’s
name.
