Objectives
According to the first clause of Article 32 of the Act on Legislative Drafting and Evaluation of Law B.E. 2562 (2019), responsible authorities with law enforcement powers shall evaluate the legislations under their responsibility. CAAT is responsible for the evaluation of 3 primary legislations, the Air Navigation Act, B.E. 2497 (1954) as amended until Air Navigation Act (No.14) B.E. 2562 (2019), the International Air Transport Act, B.E. 2558 (2015), and the Civil Aviation Authority of Thailand Emergency Decree B.E. 2558 (2015).
A public consultation with related legal stakeholders must also be held according to the evaluation guidelines approved by the Law Reform Commission and Cabinet through the central legislation system (Law Portal). Evaluation of legislations are to ensure that only necessary laws are enacted and aligns with universal standards and international obligations to minimize redundancies and conflicts of laws, reduce inequality, promote fairness in society and increase Thailand’s competitive capacity. Evaluation must be completed by 1 January 2025.
Summary
CAAT has evaluated 3 primary legislations, which are the Air Navigation Act, B.E. 2497 (1954) as amended until Air Navigation Act (No.14) B.E. 2562 (2019), the International Air Transport Act, B.E. 2558 (2015), and the Civil Aviation Authority of Thailand Emergency Decree B.E. 2558 (2015), by:
