Depositions

• Represent the only way in discovery that attorneys can rapidly assess

the potential credibility and demeanor of expert witnesses.

• Tend to occur at the culmination of the discovery process.

• Preparation for witnesses includes a review of all pleadings and

discovery materials of the case.

• Notice of deposition may arrive accompanied by a subpoena duces

tecum, requiring the expert to appear with specific documents.

• Experts reserve the right to review the transcript and make corrections
to their deposition.
