Future Development Phase. Seller intends to replat the property currently platted as the following:
o The Hollows, Phase II-A, Lots 26 through 31, Block G; and Lots 1 through 9, Block H; and
o The Hollows, Phase II-B, Lots 2 through 25, Block G; and Lots 10 through 20, Block H; and Lots 1 through 8, Block I; and the streets depicted as Serenity Place, Tranquility Falls and Liberty Grotto (collectively referred to as the "RFR Tract")
to change the lot configuration to enhance the marketing and development potential of the RFR Tract (the "RFR Tract Replat"). Due to the shape of the RFR Tract, and its topography, Seller will not be able to achieve uniformity in the shape or size of all RFR Lots, however, Seller will attempt to create RFR Lots that are approximately 60 feet wide in the construction area, with an overall area of each RFR Lot of approximately 7,800 square feet or greater.
Commitment of RFR Tract. Buyer acknowledges that it is one of three Builders holding the right to purchase Finished Lots from Seller and market new homes in The Hollows. As such, Buyer is hereby granted the right of first refusal described in this Addendum 2 to Exhibit A to purchase one-third of the Finished Lots created by Seller through the RFR Tract Replat and development of the RFR Tract (the "RFR Lots") (subject to adjustment if the number of RFR Lots created as legal lots by the RFR Tract Replat is not evenly divisible by three).
Home and Landscape Design: Subject to review and approval by Developer and architectural control requirements.
Fees:
• Taxes: Property taxes and other customarily pro-ratable items against the Lots will be prorated between Builder and Developer as of each Closing Date.
• Project Marketing Support Fee: $2,000/Lot
