FROM THE PRESIDENT
Dear Members:
As we start a new year, I want to thank the board trustees whose term expired and who will not be serving with us this year. This list includes Pierre Amestoy, Kevin Blach, Brad King and Bobby McQueen. Each of these individuals contributed significantly to the NMHBA with ideas and a dedication to making the organization better. I also want to welcome the new board trustees – Denton Crozier, Mindy McArthur, Tom Pierce and Bill Shepard. I’m looking forward to working with each over the next year.
While this topic might already be familiar to many of you, I want to discuss the governance of the breeders’ association. The NMHBA is designated in the Horse Racing Act (NMSA
Chapter 60, Article 1A) to receive and administer distributions related to merit and incentive awards for New Mexico-bred horses. These statutes were written to help promote the breeding industry in New Mexico by enhancing purse monies for breed races and by providing incentive awards. The Horse Racing Act specifies where the monies are coming from (retainage, breakage and uncashed tickets) and where these monies will be distributed. The Act was obviously written by a group that understood the importance of enhancements to both stakes and overnight races.
Gaming at the racetracks is authorized in the Gaming Control Act (NMSA Chapter 60, Article 2E). This Act was created by legislation during the 1997 legislature and specifies the laws governing racetrack casino (or racinos). NMHBA is not mentioned in the Gaming Control Act but there
is a gaming tax specified for purse enhancements. As part of this, rules were adopted by the New Mexico Racing Commission in 1999 to distribute 80.7% of the gaming tax to the existing purse structure and the remaining 19.3% to the NMHBA Gaming Purse Fund. The NMHBA Gaming Purse Fund enhances the stakes and overnight races for the breeds and also provides monies for the incentive awards.
The next level of governance for NMHBA is a set of ByLaws that have been in place for decades and serve as the building blocks for the rules of the organization. These Bylaws cover the definition of a New Mexico bred horse, the makeup and duties
of the board of trustees and other important basics. These Bylaws are meant to be fairly static and are only changed by a vote of the membership.
The last level of governance for NMHBA
are the rules and procedures as defined and approved by the board of trustees. These rules and procedures are the basics of how the board of trustees and the staff adhere to the higher levels of governance described above. As such, these rules and procedures are more pliable and a lot of time is expended making sure the rules are concise and the procedures are beneficial to the membership.
This is probably a fairly “dry” subject but it is important to understand how the NMHBA functions as an organization. The trustees as board members have a duty to adhere to these governance levels and to recommend or make changes where it is beneficial to the future of the organization.
