NATURE OF WARRANTY: We hereby guarantee that all material and labor included in our Subcontract scope of work
was furnished, installed, and/or performed in strict accordance with the contract documents. We agree to repair or replace
any and all of our work which does not conform with the contract documents and/or the professional standard of care
common to contractors performing this work, together with any other adjacent work which may have been displaced or
damaged by us during the performance of our work, due to any degree of defect in our workmanship or materials or failure
to comply with appropriate standards of care.
PROCEDURES FOLLOWING BREACH OF WARRANTY: In the event of any breach of this warranty and guarantee, or
failure to comply with the contract documents, we will perform all necessary corrective work, and to repair any adjacent
work which may be displaced or damaged by the corrective work, within five (5) calendar days after being notified in writing
of such breach, failure, or defect. In the event of our failure to comply with the provisions of this guarantee, we separately
and collectively hereby authorize JWC and/or the Owner or successor in interest to proceed with all necessary steps
required for complete compliance, and to do so at our expense, and we will honor and pay the costs and charges therefore
upon demand.
ACKNOWLEDGMENT OF FURTHER POTENTIAL CONSEQUENCES: We acknowledge that failure to suitably and fully
honor this warranty may further subject us to statutory and regulatory requirements governing guarantee and warranty
standards appropriate to our industry.
EXTENT OF WARRANTY AS TO TIME: (The following minimum warranty timelines are applicable unless exceeded,
consequently superseded, by the Subcontract documents.)
