9. GRIEVANCE & DISCIPLINARY
9.5ii. Examples of Gross Misconduct
The conduct set out below will, depending on the circumstances of the particular case, usually be considered as gross misconduct. The list is not to be taken as exhaustive:
• Violent, Threatening, or Rowdy Behaviour.
• Physical or Verbal Assault, swearing at a collegue or a line manager or Gross
Insubordination.
• Apparent intoxication or being in possession of or under the influence of alcohol
or drugs at Work. (Excluding those as prescribed by a GP.)
• Damage, loss or misuse of Company, Client, Customer or other employees’
property.
• Fraudulent Absence from work.
• Falsification of company documents or personal records.
• Action which endangers the health and safety of yourself and/or others.
• Deliberate non-co-operation or failure to obey a reasonable non-dangerous order
or instruction issued by an authorised person.
• Theft and Fraud
• Actual acts or acts of incitement to cause Discrimination, Sexual or Racial
Harassment or failure to comply with the Company’s Equal Opportunities Policy.
• Neglect, or wilful or malicious breach, of Statutory or Company Hygiene, Health
& Safety Regulations.
• Illegal, immoral or malicious use of the internet, social media or email.
• Any communications in a work or personal capacity through social media that may
breach confidentiality, constitute discrimination, bullying or harassment or brings the Company into disrepute. Any communication or relationship with a school pupil or minor via the internet, social media, text message, telephone, in writing or through personal contact, which occurs outside the scope of legitimate school duties.
• Obscene Behaviour towards work colleagues, line managers, visitors, clients or Customers.
• Committing an act outside work, or being convicted for a criminal offence, which may adversely affect the employment contract or the relationship between our Clients, the Employee and the Company.
• Disloyalty or any action which brings the Company into disrepute.
