9. GRIEVANCE & DISCIPLINARY
Level 2 First Written Warning
If the offence is of a more serious nature, a further episode of misconduct occurs or there is no improvement in standards following a previous issue of misconduct or capability, a FIRST WRITTEN WARNING will be issued. This will detail the reasons for the warning, the consequences of repetition or failure to achieve acceptable standards and the right of appeal. This warning will remain active for a period of SIX MONTHS.
Level 3 Second/Final Written Warning
If any misconduct occurs within the first six months of employment, or an act of SERIOUS MISCONDUCT occurs or a previous issue of misconduct fails to improve sufficiently or is repeated, a SECOND/ FINAL WRITTEN WARNING will be issued. This will detail the complaint, warn that dismissal or alternative action will result if there is no satisfactory improvement or, if any further act of misconduct occurs within the stated period. It will also advise of the right of appeal and that the warning will remain active on their personnel file for a minimum of TWELVE MONTHS. If a longer rehabilitation period is deemed justifiable, the people and training department must be consulted.
Level 4 Dismissal (or Alternative Action)
If there is no satisfactory improvement in conduct or performance, or further acts of misconduct occur after Level 3, DISMISSAL or SOME ALTERNATIVE ACTION such as demotion will result. The date on which the employment will terminate and details of the right of appeal will be provided as soon as possible and written reasons for dismissal will be provided on request.
Level 5 Summary Dismissal
If an act of GROSS MISCONDUCT is suspected, the person may be suspended with pay while a full investigation is completed. If after investigation, it is confirmed, or the company has reasonable grounds to believe that an act of GROSS MISCONDUCT has been committed, they will be liable for SUMMARY DISMISSAL. The date on which the employment will terminate and details of the right of appeal will be provided as soon as possible and written reasons for dismissal will be provided on request.
