MEMORANDA 1 Breakdown
In the event of breakdown of the means of conveyance during transit or if, for any reason beyond the Insured’s control, the property is endangered, nothing contained herein shall debar the utilization of any other form of transport to assist completion of the transit and the insurance afforded shall not be affected thereby.
Conveyance
Means of conveyance shall be deemed to be by road, rail or air.
Other means of transport
Where the means of conveyance is by specified vehicle, the insurance under this Section shall apply to property on any vehicle temporarily used in place thereof while a specified vehicle is undergoing repair or servicing, which replacement vehicle is not the property of the Insured or leased or hired by them under a lease or suspensive sale agreement.
Period of transit
Transit shall be deemed to commence from the time of moving the property described in the Schedule at the consignor’s premises (including carrying to any conveyance and loading thereon), continue with transportation to the consignee (including temporary storage not exceeding 96 (ninety six) hours in the course of the journey) and end when off-loaded and delivered at any building or place of storage at the consignee’s premises.
Refusal
If any consignee shall refuse to accept property consigned, transit shall be deemed to continue and the insurance in respect of such property shall continue in force until the property is delivered at the premises of the consignor by any means of conveyance;
PROVIDED THAT:
the Insured shall take all reasonable steps to ensure that the property is returned as soon as is reasonably possible.
SPECIFIC EXCEPTIONS
The Company shall not be liable for:
1. frostbite, poisoning of any kind or strange objects in the alimentary canal of any of the livestock or pedigree animal, erroneous feeding or erroneous dosage whether malicious or by accident;
2. attack by dogs or wild animals;
3. destruction, in compliance with the requirements of any statute or any order of a government department or local authority;
4. detention, confiscation, forfeiture, impounding or requisition by customs or other officials or authorities;
5. loss or damage to property including accident or disease sustained or contracted outside the Republic of South Africa, Namibia, Botswana, Lesotho, Eswatini (formerly Swaziland), Zimbabwe, Malawi, Mozambique and Zambia;
6. the dishonesty of any principal, partner, director or employee of the insured whether acting alone or in collusion with each other;
7. unfitness for or incapacity to fulfil the functions or duties for which the livestock and pedigree animal is kept;
8. accident or disease sustained or contracted during transit by air or by sea;
9. the intentional slaughter or destruction of livestock and pedigree animals whether by or under order of any government or public or local authority or any person or body having jurisdiction in the matter or otherwise;
PROVIDED THAT:
the Company will not invoke this particular Exception as a defence where:
1. the Company shall have expressly agreed to destruction of the livestock or pedigree animal or;
2. an insured animal (including pedigree animal) suffers an injury or is affected with an excessively painful disease and a qualified veterinary surgeon appointed by the Company certifies that it is incurable and so excessive that immediate destruction is imperative for humane reasons, or;
