Jewellery, furs, photographic equipment and/or oriental carpets and rugs
Unless specifically otherwise agreed by the Company and stated in the Schedule, the total value of platinum, gold and silver articles, jewellery, furs, photographic equipment and/or oriental carpets and rugs shall be deemed not to exceed one third of the sum insured in respect of the contents per item stated in the Schedule;
PROVIDED THAT:
The Company’s liability for theft of unspecified jewellery and/or unspecified watches will be limited to a maximum amount of R150 000 (hundred and fifty thousand rand) any one claim.
Landscaping
The Company will pay up to R10 000 (ten thousand rand) per event towards costs reasonably and necessarily incurred by the Insured for the replacement of trees, shrubs, lawns, plants and fixed sprinkler installations situated at the grounds of the insured buildings stated in the Schedule;
PROVIDED THAT:
such loss or damage is caused by:
1. fire, explosion or as a result of firefighting operations;
2. any other emergency service operations;
3. impact by vehicles or aircraft or other aerial devices, any deliberate or malicious acts;
4. but excluding theft or attempted theft.
Liability to domestic personnel
This Section covers:
1. all sums for which the Insured is legally liable to pay for compensation in respect of death of, or bodily injury to or illness of any domestic personnel arising out of and in the course of the period of such domestic personnel’s employment with the Insured in his/her capacity as a householder at the premises and occurring during the period of insurance as a result of an accident;
2. all legal costs and expenses:
2.1 recovered by any claimant against the Insured;
2.2 incurred with the written consent of the Company
in respect of a claim against the Insured for compensation to which the indemnity expressed in this Contingency applies; PROVIDED THAT:
the amount payable in respect of any one accident or series of accidents arising out of one event will not exceed R5 000 000 (five million rand) inclusive of all compensation and all legal costs and all other costs and expenses.
In addition and in connection with the employment of such domestic personnel by the Insured, the Company will indemnify the Insured against costs and expenses not exceeding R2 000 (two thousand rand) incurred by the Insured with the consent of the Company in the defence of any criminal action brought against the Insured arising out of an alleged contravention of the Occupational Health and Safety Act no. 85 of 1993.
The indemnity expressed in this Contingency does not apply to nor include:
1. liability assumed by agreement and which would not have attached in the absence of the agreement;
2. costs and expenses incurred subsequent to the date on which the Company has paid or offered to pay either the full amount of the claim or the total amount recoverable in respect of any occurrence.
Loss of locks, keys and remotes
The Company will indemnify the Insured in respect of the cost of replacing locks, keys, and remotes including the remote alarm controller and, if necessary, the reprogramming of any coded alarm system of any insured property, following upon the disappearance of any key or alarm controller, following upon the Insured having reason to believe that any unauthorised person may be in possession of a duplicate of such key or alarm controller;
