3. one or more stacks/piles or groups of stacks/piles collectively not exceeding R350 000 (three hundred and fifty thousand rand) and situated less than 100 (one hundred) meters from each other shall be deemed to constitute one fire risk.
2. Memorandum
It is a condition precedent to liability of the Company that all flammable materials and vegetation’s within an area of at least 10 (ten) meters shall be cleared and removed around every stack/pile or in a group of stacks/piles constituting one fire risk.
3. Stacks Guarantee
Regarding “Ouland” grass (Eragrostis) and/or field grass cover shall only be applicable on baled grass harvested during the current season.
Subject otherwise to the terms, conditions and exclusions of this Section and Policy.
Raisins and Drying Mats in the Open 1. Raisins in the Open
1.1 In the event of loss of or damage to the insured property described in the Schedule, as a result of wind, direct water damage or accompanied by water erosion, overflowing and/or flood, as defined under Defined Event 6 (special perils), the Company shall not be liable to pay more than 75% (seventy five percent), or should any other insurance exist, the rateable portion of 75% (seventy five percent) of the market value of the insured raisins or the amount nominated by the Insured in accordance with the Basis of Valuation contained in this Special Proviso applicable to raisins in the open, whichever is the lesser, immediately prior to the event;
PROVIDED THAT:
1. the Insured shall be considered as being his own insurer for 25% (twenty five percent) of the nominated amount;
2. the liability of the Company in respect of raisins in the open on drying installations and/or in sulphur pens and/or in the open on drying slabs shall not, exceed R2 000 000 (two million rand) in the annual aggregate any one risk location or the amount stated in the Schedule;
3. cover in respect of raisins on stacked drying installations is subject to the installation being securely anchored to the ground with ropes and/or wire cables;
4. cover in respect or raisins on drying slabs are subject to all reasonable precautions being taken to protect raisins against loss or damage resulting from direct water damage accompanied by water erosion, overflowing and/or flood;
5. a 72 (seventy two) hour time exclusion will apply from commencement of cover.
6. the Company shall not be liable to compensate the insured for any loss or damage caused by:
6.1 rot or decay of raisins as a result of excessive moisture and/or dampness;
6.2 down grading of quality as a result of the effect of abnormal weather conditions.
1.2 Valuation
The basis of valuation in terms of raisins shall be applied as follows:
