Legal costs
Iden ty the
In the event of iden ty the , you will need to obtain new personal documents and have your credit status reinstated.
The maximum amount we will pay for this is based on the tari s of our preferred a orneys, up to the limit speci ed in the Schedule.
What we cover you for
We cover you for legal costs and expenses, based on our tari s and limits, a er we have decided that there is merit in pursuing a legal solu on arising out of any of the following only:
○ Civil ac on
Any civil ac on by you or against you
○ Criminal charge
Defence of any criminal charge against you excluding a ne or bail that is levied against you
○ Labour rela ons
Any legal ac on by you or against you, in a labour court
○ Family ma ers
Any legal ac on rela ng to family ma ers such as divorce, custody or maintenance
Where any cover is subject to a wai ng period, you may claim only once it has ended. Please check your Schedule now for the wai ng periods that may apply to you.
Iden ty the
If your personal iden ty document is stolen, or any con den al informa on rela ng to your iden ty is copied or obtained without your authorisa on, we will cover you for the following, as long as the the occurred a er the policy started:
○ the nancial loss su ered by you as a direct result of the iden ty the
○ all reasonable costs incurred in order to reinstate your credit status to the posi on it was in before the iden ty
the
○ all reasonable costs incurred in order to monitor your credit status through a credit bureau of our choice
○ all reasonable costs (such as telephone calls, le ers, a davits, copies of documents, etc.) incurred to replace any stolen cards or iden ca on documents
○ loss of income for each whole day of unpaid leave you may have to take to a end to and reclaim your iden ty.
Di erence between civil ac on and criminal ac on
A civil ac on is when one person ins tutes legal proceedings against another person to protect their rights, or because they believe a wrong has been done to them. A successful outcome results in damages being awarded in favour of the winning party.
