 Annexure A – Treaty Exclusions
 3.5 Worldwide Punitive Damages Clause (LGT399) (1994)
Notwithstanding anything to the contrary contained herein it is understood and agreed that punitive damages and/or exemplary damages and/or aggravated damages and/or any additional damages resulting from the multiplication of compensatory damages against an original insured.
3.5.1 In respect of any claim arising under a policy which specified that indemnity is provided for such damages;
or
3.5.2 In respect of any judgment award or settlement made within the legal jurisdiction of the USA and/or Canada or to any order made anywhere in the world to enforce such judgment award of settlement in whole or in part.
shall be excluded from recovery hereon.
3.6 Worldwide Claim Made Basis (LGT400) (1994)
Notwithstanding anything to the contrary contained herein it is understood and agreed that claims made coverage written:
3.6.1 without a retroactive date; and/or
3.6.2 with a retroactive date which is prior to inception of the current uninterrupted claims made coverage; and/or
3.6.3 with an original policy extended reporting period exceeding 36 months beyond expiry of the policy
shall be excluded from recovery hereon.
3.7 In respect of injury, or damage happening in the United States of America or Canada caused by or through or in connection with any goods or products sold or supplied by or to the order of the Insured if such goods or products have to the Insured's knowledge been exported to the United States of America or Canada by or on behalf of the Insured.
3.8 Professional Indemnity of any kind.
3.9 Products Guarantee and Recall covers.
3.10 Pharmaceutical/Chemical manufacturing risks (other than retailers) unless on a Claims Made Basis.
3.11 Clinical tests or trial of drugs not carried out in compliance with the terms of the Medicines Control Act Number 101 of 1965 or similar legislation in other territories.
3.12 Directors and Officers Liability.
3.13 Bankers Blanket Bond policies.
3.14 Medical Malpractice.
3.15 Prospecting, Extracting and Refining of Liquid or Gaseous Fuel.
3.16 Industries, Seepage, Pollution and Contamination Clause.
3.16.1 Personal Injury or Bodily Injury or loss of, damage to, or loss of use of property directly or indirectly caused by seepage, pollution or contamination, provided always that this paragraph (i) shall not apply to liability in respect of death, bodily injury, illness or loss of or damage to material property or loss of use of such property where such seepage, pollution or contamination is caused by a sudden, unintended and unexpected happening.
3.16.2 The cost of removing, nullifying or cleaning-up seeping, polluting or contaminating substances unless the seepage, pollution or contamination is caused by a sudden, unintended and unexpected happening.
