Annexure A – Treaty Exclusions
7. Applicable To Watercraft (business issued and renewed basis on or after 1 March 2007)
7.1 Offshore related risks, inland coastal and/or ocean going marine risks, other than pleasure craft and/or where such risks involve the use of crafts as tools of trade within fifty nautical miles from the coastline.
7.2 7.2.1
War invasion act of foreign enemy hostilities or warlike operations (whether war be declared or not) civil war mutiny military or popular rising insurrection rebellion revolution military or usurped power.
7.2.2 Any act of any person acting on behalf of or in connection with any organization with activities directed towards the overthrow by force of any Government de jure or de facto or to the influencing of it by terrorism or violence.
7.2.3 Martial law or state of siege or any events or causes which determine the proclamation or maintenance of martial law or state of siege.
7.3 Non-Marine Liability Exclusion Clause (1987).
7.4 Seepage and Pollution Exclusion Clause (1.1.87)
This contract excludes any loss arising from seepage, pollution or contamination on land unless such risks are insured solely on a sudden and accidental basis. This contract also excludes liability in respect of disposal or dumping of any waste materials or substances.
This exclusion shall not apply to coverage provided in respect of:
7.4.1 control of well policies where such seepage, pollution or contamination follows as well out of control above the surface of the ground or waterbottom;
7.4.2 liability under:
7.4.2.1 Offshore Pollution Liability Agreement
7.4.2.2 Outer Continental Shelf Lands Act, Federal Water Quality Improvement Act, Arctic Waters Pollution Protection Act
7.4.2.3 Seepage, pollution or contamination covered by Protection and Indemnity policies 7.4.2.4 Aviation policies subject to clauses no less restrictive than AVN 46B;
7.5 Single handed navigation outside South African, Namibian, Mozambican and Angolan Territorial Waters.
7.6 Confiscation risks.
7.7 Insurances of all cargoes.
7.8 Vessels whilst being towed or whilst towing other vessels except such towage as is permitted by the “tow and assist” clause in the Institute Time Clauses – Hulls (Navigation).
7.9 Professional Racing risks unless agreed by Leading Reinsurer.
7.10 Radioactive Contamination as per the Institute Radioactive Contamination Exclusion Clause (01/10/90) CL356
This clause shall be paramount and shall override anything contained in this insurance inconsistent therewith:
7.10.1 In no case shall this insurance cover loss damage liability or expense directly or indirectly caused by or contributed to by or arising from

ionising radiations from or contamination by radioactivity from any nuclear fuel or from any nuclear waste or from the combustion of nuclear fuel
the radioactive, toxic, explosive or other hazardous or contaminating properties of any nuclear installation, reactor or other nuclear assembly or nuclear component thereof
any weapon of war employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter.
