this plan until You are eligible for the bargaining unit’s benefits. Once eligible for bargaining unit benefits,
You cannot continue under this plan.
Family Members Who Are Eligible
You may enroll eligible family members at the same time You enroll in this plan.
You also may want to enroll eligible family members during a Special Enrollment Period or during the Annual
Open Enrollment Period. (See “Special Enrollees” and “Annual Open Enrollment Period” later in this
section.)
You may add any of the following to Your membership:
Your spouse or domestic partner;
Your natural children
Your spouse’s, or Your domestic partner’s natural children (effective status);
Your spouse’s, or Your domestic partner’s legally adopted children;
children placed in Your physical custody for adoption;
children for whom You are the legally appointed guardian;
foster children that live with the Employee and for whom the Employee is the primary source of
financial support;
children You must cover under a Qualified Medical Child Support Order. You may obtain a copy of
this plan’s Qualified Medical Child Support Order (QMSCO) procedures and Qualified Domestic
Relations Order (QDRO) from Your plan administrator at no charge.
For the purposes of this Plan, a Spouse is defined as a person who is recognized under state or federal
law. This includes same sex spouses when legally married in a state that recognizes same-sex marriages.
To be eligible for coverage, a child must also be under age 26 (end of month).
Children of Your dependent children cannot enroll under Your membership unless You are their legal
guardian or You are adopting the children.
If a dependent child also works full-time for Aegion, the child must apply for his or her own coverage.
If a person qualifies as a domestic partner, You can add that person to this health benefits plan. Employees
may add their domestic partners children to the Plan.
To qualify as a domestic partner under Your plan, a person must be:
mentally competent
age 18 or over
of the same or opposite sex of the subscriber
the subscriber’s sole partner, who is not in the relationship for the sole purpose of obtaining health
benefits
not related by blood to a degree of closeness that would prohibit marriage
not legally married and must not have had another domestic partner during the previous six months
living with the subscriber indefinitely
financially interdependent with the subscriber, who can prove such interdependence if requested
by Anthem.
Proof of financial interdependence must include at least one of the following: common ownership or
leasehold of real property, proof of designation as primary beneficiary of life insurance or retirement
benefits, primary designation under the partner’s will, or assignment of a durable power of attorney for
property or health care.
