CHAPTER 2: GETTING STARTED
Additionally, in accordance with 41 USC § 4712, Post will not discharge, demote or otherwise discriminate against an associate in reprisal for disclosing to a member of Congress or a representative of a committee of Congress, an inspector general, the Government Accountability Office, a Treasury employee responsible for contract or grant oversight or management; an authorized official
of the Department of Justice or other law enforcement agency, a court or grand jury, or a management official or other person who has the responsibility to investi- gate, discover or address misconduct, information that the associate reasonably believes is evidence of gross mismanagement of a federal contract or grant, a gross waste of federal funds, and abuse of authority relating
to a federal contract or grant, a substantial and specific danger to public health or safety, or a violation of law, rule, or regulation related to a federal contract (including the competition for or negotiation of a contract) or grant.
OUTSIDE EMPLOYMENT
At Post, students and colleagues deserve nothing less than 100% effort from other colleagues, all the time. This expectation cannot be jeopardized as a result of external, secondary employment.
While an associate’s personal choice to secure outside employment may be understandable, the associate’s employment with Post is required to be the associate’s primary employment unless the associate is employed on a part-time basis. Outside employment is not appropriate, if in the discretion of Post, it would
1.) compete with Post’s business; 2.) create a conflict of interest; 3.) interfere in any way with the associate’s job performance; or 4.) interfere with or adversely affect, or could interfere with or adversely affect Post’s business/reputation.
As a related matter, qualified full-time associates may perform secondary roles in different departments such as part-time Academics Associate Faculty.
A full-time associate’s selection for part-time Associate Faculty openings may vary each term and is largely based on the associate’s satisfactory performance in current role, course enrollment census, the required Instructor qualifications/ credentials and other business needs.
This type of additional employment may not result in an inappropriate supervisory reporting relationship that violates Post’s policies.
Full-time associates who have maintained acceptable performance and meet the specific qualifications for an available Associate Faculty opening may be approved for a teaching assignment of 1 course per term with exceptions made for 2 courses per term based on the respective supervisor’s review of the situation.
Associates who are qualified and approved by their supervision to perform as a part-time Associate Faculty must maintain acceptable performance and a work schedule as routinely required.
Keep in mind all employment with Post in any position is considered at-will with no guarantee of continued employment. Questions related to this policy should be directed to your supervisor or Associate Experience.
NON-COMPETITION AND NON-SOLICITATION
Dependent upon the associate’s position and responsibilities, associates may be required to agree
to not compete with the University for a specified time frame following employment with Post. Additionally, associates are not permitted to solicit other Post associates to leave the employment of Post or otherwise interfere with Post’s business operations following the separation of the associate’s employment with Post.
Non-Competition: During associate’s employment with the University and for the twelve (12) month period following the termination of associate’s employment with the University, associate shall not, directly or indirectly, own, manage, operate, control, be employed by (whether as an associate, consultant, independent contractor or otherwise, and whether or not for compensation) or render services to any person, firm, corporation or other entity, in whatever form, engaged
in the business of providing for-profit post-secondary education services, within the states of Connecticut, Pennsylvania, Massachusetts, New York, New Jersey, New Hampshire, Rhode Island, and Vermont. This section shall not prevent associate from owning not more than one percent of the total shares of all classes of stock outstanding of any publicly held entity engaged in such business.
Non-Solicitation: For the twelve (12) month period following the termination of associate’s employment with the University, associate shall not, directly or indirectly
a) solicit or induce, attempt to solicit or induce, or aid others in soliciting or inducing, directly or indirectly, any associate or agent of, or consultant of the University to terminate its, his or her relationship with the University; or b) hire or aid others in hiring, directly or indirectly any associate, agent or consultant of the University or former associate, agent or consultant of the University who was employed by or acted as an agent of or consultant for
the University at any time during the twelve (12) month period preceding the termination of the associate’s employment.
