Featured Case Study: Not an Execution / 1st Degree Murder (Expert Consultation)
Our agency was retained by the defendant's attorney to assist in the criminal defense of fatal shooting. The defendant
was charged with first-degree homicide. The lead law enforcement detective testified before a grand jury, less than two
weeks post-event, the defendant executed the decedent with four gunshot wounds to back as he lay unconscious on the
floor. He further testified he had not attended the autopsy or read the report, available before and at his testimony.
When a grand jury member presented the question of what evidence there was of an execution-style murder, the
detective's testimony was the grouping and trajectory of the four gunshot wounds to the back and head.
In reviewing the evidence, and developing location of the handgun, it was determined the decedent first brandished his
handgun threatening the defendant. A struggle followed with the defendant having control of the handgun and the
decedent blocking the only means of escape. In fear for his life, the defendant first fired and struck the decedent in the
abdomen, then as further struggle followed, shot three more times as he fled the scene, striking the decedent in the
back before he fell to the floor. This was evidence by an entrance wound of the abdomen not disclosed in the grand jury
testimony, as well as the differing trajectories of the entrance wounds to the back - including the exit wounds did not
have corresponding defects in the floor. Following disclosure, the prosecution requested the lead detective (then
retired) to respond and issue a new report.
