        Federal Legislative Watch From NCISS
        PRO Act

        The PRO act is really two parts. The majority of the act deals with the ability of unions to organize more easily. The act is
        supported by labor unions and is likely heavily opposed by anyone in business. The act alters the definition of
        independent contractor from the Common Law Control test to the ABC test – please research these differences. The ABC
        test is what now exists in California with exemptions. Not all states use the ABC test, some use the A & C sections only.
        The ABC test on a national scale could be disastrous. Investigators and security are not the target of this legislation but,
        as usual, collateral damage. The direct target are the “gig” economy workers such as Uber or Lyft.

        The Professional Private Investigators Association of Colorado (PPIAC – www.PPIAC.org) continues to closely monitor
        pending and introduced legislation. Colorado has seen multiple bills introduced, which impact our profession and our
        clients.
