• Joe Victim stated knowing the knife he describes was near – the Defendant kept knives around by the chair. After
the Defendant reported a third knife found, The Investigator explained knife was found behind curtain behind night
stand, Joe Victim then said knife always in a cubby hole.
• Joe Victim stated Defendant got curved fillet knife [no handle color – white or black] in (R) hand and stabbed him in
the chest and cheek. The knife was reported as ½” wide and 6” long. The fillet knife is not curved and is more
accurately measured by the photograph scales as being 1.8cm at its widest point and also at 5” depth.
• During medical treatment, Joe Victim given a Rapid Urine Drug Screen 11/27/2021 @ 2345 hours and was positive
for alcohol .16 BAC).
• Joe Victim was ordered by treating physician to 84 hours of hospitalized detoxification treatment.
• Victim is never interviewed on video or considered to be false reporting.
INJURIES AND EVENTS
• The Use of ‘puncture’ ‘laceration’ in all medical and law enforcement reports are inaccurate. These injuries are
‘stabbing’ and ‘incised’: 1) sharp force stab wounds of the left cheek and left chest of Joe Victim; and 2) sharp force
incised wounds to the right fingers of the Defendant.
• Joe Victim – there are two injuries: 1) sharp force stab wound to the left cheek of 2.3cm by image scale; and 2) left
chest / lung with a depth as 5cm depth (treating physician) and 2.5cm wide by image scale.
[The Investigator incorrectly reports this was a laceration and was 2cm requiring two sutures. The injury is described
above and a 2mm injury would likely not be sutured].
• Based on both Defendant and Reporting Victim stating below shoulder jabbing motion by the Defendant, his incised
injuries to palmar finger surfaces indicate blade sharp-edge was upward (supported by the defect in the shirt worn
by Joe Victim).
• The investigation concludes, and is incorrectly emphasized to the Defendant when interviewed, the butcher knife
initially stated to be used could not have been. This is incorrectly stated to the Defendant the blade was too wide to
cause the injury to Joe Victim.
• The white handled fillet knife with a handle strap and guard was recovered. This is the knife Investigators informed
the Defendant and Joe Victim had to be used – even with neither describing this knife. With minute blood on the
blade, they falsely informed the Defendant and Joe Victim differently of the amount of blood.
• The white handled fillet knife had more blood on the handle, but not likely from being gripped or used – more likely
from having blood dripped onto while in the sink (noting the Defendant stood over the sink with a bleeding incised
wound to a hand). Specifically, as seen and photographed in the kitchen sink: 1) minimal blood inside strap and
outside handle; and 2) maximum blood outside strap and inside handle.
• The white handled fillet knife blade dimensions, like the butcher knife, may be consistent with wound dimensions.
However, the strap and guard would prevent the Defendant from moving hands as stated. This was likely not the
weapon used.
• The found black handled fillet knife (01/28/2021) like the butcher knife, may be consistent with wound dimensions.
However, there is no dried blood and the blade is not curved as stated by Joe Victim (after having been coerced to
the white handled blade fillet knife. This was likely not the weapon used.
• The found butcher knife is compatible with the wound dimensions when using the correct dimensions and
considerations of injury causation to the compression flexibility of the skin. Moreover, both incised wounds of Joe
Victim are greater than the widest blade width (including at 5” depth) of the white handled fillet knife. The most
reliable dimensions are from the scaled photographs: 1) Chest – 5cm depth and 2.3cm wide; and 2) Cheek –
unknown depth and 2cm wide. These are reported in the medical record at 1.5cm and 2.0 cm, respectively. This
was likely the weapon used.
• Specific to the defect of the shirt worn by Joe Victim. Material is not flexible, such as skin and tissue, with the defect
in a scaled image measured at 1.6cm. The depth of the wound remains flexible with the skin and tissue as the
clothing material will typically travel with the shirt and weapon.
CONCLUSIVE OBSERVATIONS:
These reported deficiencies are primarily the physical evidence is not provided for in this investigation. These deviations
and exclusions give rise to the concern the mitigating and exculpatory evidence has been ignored and denied the
Defendant. Of elevated concern are: 1) the manner in which the Defendant and Joe Victim were each interviewed; 2)
