Substance Abuse Policy

Kontoor Brands (Kontoor) is committed to providing a safe work environment and fostering the well-
being and health of its employees. As part of this commitment, Kontoor has established the following
rules relating to substance abuse. Employees are prohibited from:
1. Using, possessing, selling, trading, offering for sale, or offering to buy illegal drugs (including
related paraphernalia) or otherwise engaging in the illegal use of drugs on or off the job;
2. Reporting to work or performing any work while under the influence of or while having in his or
her body illegal drugs in any detectable amount;
3. Using, possessing, selling, trading, offering for sale or offering to buy alcohol at work (excepting
any Company-approved functions);
4. Reporting to work or performing any work while impaired by alcohol or while having alcohol in
his or her body alcohol sufficient to yield a positive alcohol result;
5. Illegal use of, possession of, trade of, offer for sale of, or offer to buy prescription and/or legal
drugs, i.e., using prescription drugs that have not been legally obtained, or obtained or used in a
manner or for a purpose other than as prescribed.
6. Using, possessing, or being under the influence of medical marijuana while at the place of
employment or during the fulfillment of employment obligations. The use of CBD and hemp
products will not be accepted as an alternative medical explanation for a positive THC result in
a drug test, except as otherwise required by applicable law.
In the absence of state law to the contrary, Kontoor considers marijuana to be an illegal drug for
purposes of this policy in all states – even those states that allow for medical and/or non-medical use.
Moreover, even if an individual’s use of marijuana may otherwise be permissible under state law, the
use or possession of marijuana or being under the influence or impaired by marijuana on Kontoor
property or while performing work for Kontoor is strictly prohibited.
Any employee in a safety-sensitive position who is undergoing medically prescribed treatment with a
prescription drug, including medical marijuana recommended by a physician, that may affect the
employee's ability to perform on the job, or who is taking/using any substance that may affect the
employee's ability to perform on the job, must report this matter to his or her HR Business Partner prior
to beginning work and comply with any limitations or restrictions imposed by his or her health care
provider. Employees who seek a reasonable accommodation due to an underlying disability are
encouraged to submit any requests to Human Resources.
A “safety-sensitive position” is one involving safety-sensitive job duties, which are defined as those that
Kontoor reasonably believes contain tasks or duties that could affect the safety and health of the
employee or others including, but not limited to, the following: the operation of a motor vehicle, other
