On or after March 15, 2021 the City of Sanger will submit a request to the State of California, Department of Housing and Community Development, for the release of HOME funds under Title II of the Cranston-Gonzales National Affordable Housing Act of 1990 as amended, and Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development Act of 1974 (PL 93-383), as amended, to undertake the following project:
Tier I Broad Review Project/Program Title: Owner-Occupied Housing Rehabilitation Program
Purpose: to provide financing to income-eligible households to rehabilitate substandard, single-family homes.
Location: Within the incorporated areas of the City of Sanger, State of California.
Project/Program Description: The City of Sanger will undertake a Housing Rehabilitation program to provide financing to income-eligible households to rehabilitate substandard, single-family homes within the incorporated areas of the City of Sanger, State of California. The program will utilize 2019 HOME, future HOME Grant funds and HOME Program Income in the approximate amount of $2,000,000.
The estimated maximum loan amount of $150,000 is projected to result in a maximum of 14 units during the five-year term from March 30, 2021 to March 29, 2026. The program is limited to projects that are categorically excluded subject to the statues per section 58.35a of 24 CFR Part 58.
The activities proposed are Categorically Excluded subject to Section 58.35a of CFR Part 58 from National Environmental Policy Act Requirements. An Environmental Review Record (ERR) that documents the environmental determinations for the area of consideration is on file at the City of Sanger, Community & Economic Development Department. Determinations for the following site-specific compliance factors will be addressed in the Site- Specific CEST review which will be on file, as completed and at the same location: National Historic Preservation Act of 1966, as amended; HUD environmental standards regarding Runway Clear Zones 24 CFR 58.6(d) and 24 CFR Part 51D; HUD environmental standards regarding Explosive and Flammable Operations, 34 CFR Part 51C; HUD environmental standards regarding toxic, hazardous, and radioactive materials 24 CFR 58.6(a).
Tier 2 site specific reviews will be completed for those laws and authorities not addressed in the tier 1 broad review for each address under this program when addresses become known.
Level of Environmental Review Citation: The program is limited to projects that are categorically excluded subject to the statues per section 58.35a of 24 CFR part 58.
Tier 2 Site Specific Review: The site-specific reviews will cover the following laws and authorities not addressed in the Tier 1 broad review: National Historic Preservation Act of 1966, as amended; HUD environmental standards regarding Runway Clear Zones, 24 CFR 58.6(d) and 24 CFR Part 51D; HUD environmental standards regarding Explosive and Flammable Operations, 24 CFR Part 51C: HUD Environmental Standards regarding toxic, hazardous, and radioactive materials, 24 CFR 58.5(i)(2); the Flood Disaster Protection Act of 1973 and mandatory flood insurance purchase requirements, 24 CFR 58.6(a).
Mitigation Measures/Conditions/Permits (if any):
Flood Insurance/Flood Zone Management: Projects will involve rehabilitation of structures, buildings or mobile homes, some of which may be located in a FEMA designated special Flood Hazard Area. Flood Insurance under the National Flood Insurance Program must be obtained and maintained for the economic life of all projects, in the amount of the total project cost. A copy of the flood insurance policy and declaration must be kept in the Environmental Review Record.
Clean Air: Scope of work will be sent to San Joaquin Valley Air Pollution Control District at time of Site-Specific Review for determination.
Response will be included in the ERR. Any recommendations provided by SJVAPCD will be followed accordingly.
Contamination & Toxic Substances: Project site address will be
entered into the National Priorities List-Superfund Site to ensure project is not within 2,000 feet of a CERCLIS site and is not adjacent to any other known or suspected sites contaminated with toxic chemicals or radioactive materials.
Endangered Species: Project site address will be entered into U.S. Fish and Wildlife Service Critical Habitat Mapper to determine if any species or designated critical habitats are listed at the project location.
Explosive and Flammable Hazards: A field observation will be conducted by a Rehab Specialist to determine if it is located within the immediate vicinity of any hazardous industrial operations handling fuel or chemicals of an explosive or flammable nature that could expose people or buildings to such hazards.
Historic Preservation: The State Historic Preservation Office will be consulted at time of Site-specific environmental review.
Noise Abatement: Rehab projects will not involve noise sensitive land development. Reconstruction projects most likely will not involve noise sensitive land development, but a determination cannot be made at the broad level. A Rehab Specialist will conduct a field observation at time of site-specific review.
Sole Source Aquifers: Site specific environmental review will be conducted to determine if the property is not located within a U.S. Environmental Protection Agency-designated sole source aquifer area.
Wetlands Protection: A site-specific environmental review will be conducted to determine if the project involves new construction within or adjacent to wetlands, marshes, wet meadows, mud flats, or natural ponds by conducting field observations and checking maps issued by USDI Fish & Wildlife Service or U.S. Corps of Engineers.
Estimated Project Cost: The Program will utilize 2019 HOME funds, future HOME Grant Funds, and HOME Program Income in the approximate amount of $2,000,000. PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the Community & Economic Development Department, Planning Division. All comments received by March 15, 2021 will be considered by the City of Sanger prior to authorizing submission of a request for release of funds. ENVIRONMENTAL CERTIFICATION
The City of Sanger certifies to State of California, Department of Housing and Community Development that Tim Chapa in his capacity as City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. State of California, Department of Housing and Community Development approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Sanger to use Program funds. OBJECTIONS TO RELEASE OF FUNDS
The State will consider objections to its release of funds and the City of Sanger’s Certification for a period of fifteen days following the its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Sanger; (b) the City of Sanger has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58 or by CEQ regulations at 40 CFR 1500-1508, as applicable; (c) the City of Sanger has omitted one or more steps in the preparation, completion or publication of the Environmental Assessment or Environmental Impact Study per 24 CFR Subparts E, F or G of Part 58, as applicable; (d) the grant recipient or other participant in the development process has committed funds for or undertaken activities not authorized by 24 CFR Part 58 before release of funds and approval of the environmental certification; (e) another Federal, State or local agency has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the State Department of Housing and Community Development Department, HOME Program, 2020 W. Medidas / Condiciones / Permisos de Mitigación (si los hubiera): Seguro contra inundaciones / Manejo de zonas de inundaciones: los proyectosincluiránlarehabilitacióndeestructuras,edificiosocasasmóviles, algunas de las cuales pueden estar ubicadas en un Área especial de riesgo de inundación designada por FEMA. El Seguro contra Inundaciones bajo el Programa Nacional de Seguros contra Inundaciones debe obtenerse y mantenerse durante la vida económica de todos los proyectos, por el monto del costo total del proyecto. Se debe conservar una copia de la póliza de seguro contra inundaciones y la declaración en el Registro de revisión ambiental.
Aire limpio: El alcance del trabajo se enviará al Distrito de Control de la Contaminación del Aire del Valle de San Joaquín en el momento de la Revisión Específica del Sitio para su determinación. La respuesta se incluirá en la ERR. Cualquier recomendación proporcionada por SJVAPCD se seguirá en consecuencia.
Contaminación y Sustancias Tóxicas: La dirección del sitio del proyecto se ingresará en la Lista de Prioridades Nacionales-Sitio del Superfondo para garantizar que el proyecto no esté dentro de los 2,000 pies de un sitio CERCLIS y no esté adyacente a ningún otro sitio conocido o sospechoso contaminado con químicos tóxicos o materiales radiactivos.
